Owners or tenants of a beach near a lake, river or sea do not have the right to charge an entrance fee to its territory. According to Article 6 of the Water Code, water bodies that are in state or municipal ownership are publicly available. Everyone has the right to access to them. Access to the beach can be closed only if the reservoir or part of it was provided to ensure the defense of the country and the security of the state, other state or municipal needs (Part 2 Art. 38 of the Water Code  RF). A the concept of "private beach" can only be applied to recreation areas near artificial reservoirs: ponds or pools.

If we are talking about  public beaches on the coast of the sea, river or lake, then, according to the Water Code, a coastal strip with a width of  20 meters is considered open for wide access.

In  -resort of Sochi reported that before the start of the season, Anatoly Pakhomov, then the mayor of the city, said that all beaches should have a strip without equipment so that tourists and local residents could sunbathe there, laying their towels. He threatened beach tenants who violated the requirements with large fines and arrest for up to 15 days.

Toilet, changing rooms and showers

According to SanPiN 2.1.3684-21, beach owners must install changing cabins, public toilets, showers, trash cans on their territory. The number of changing rooms, toilets and showers is determined depending on the area of ​​the beach. Toilets and showers must be at a distance of at least     meters and not more than 200 meters from the edge of the reservoir. The distance between toilets and showers should be no more than 100 meters.

Sunbeds, umbrellas, parking

A private person can take the land of the beach for rent. It is not the beach itself that is rented out, but an agreement is concluded for land improvement or for organization of recreation and tourism on the beach. It may provide for the opening by the tenant on the beach of trade facilities, attractions, rental of sun loungers and umbrellas, inventory and equipment for swimming, etc. That is, for all these services, he can legally charge a vacationer.

However, there were situations when tenants did not allow visitors to the beach, demanding payment for a sun lounger. Or they took money for entry to the beach, and a sunbed was provided «as a»gift». This is illegal, as it contradicts the Water Code and  Art. 16 FZ «On protection of consumer rights», which prohibits the imposition of services.

B p. 6.1. GOST R 55698-2013 “Tourist services. Beach services. General requirements» it is stated that the following additional services can be organized on the beaches related to the creation of amenities for beach visitors:

• entertainment;

• learning to swim, dive, surf, etc. p.;

• rental of beach umbrellas, sun loungers, sun loungers, mattresses and towels;

x rental of tourist equipment and equipment for swimming and diving;

• animation services for children, children's playrooms;

• swimming pool;

• photo and video services;

• organization of food outlets and small retail trade;

• sale of related products, including souvenirs, hygiene products, perfumes, cosmetics and other products;

x provision of organized parking for cars of tourists and etc.

In these cases, it is the right of the beach owners and renters to provide these services, and not obligations        Therefore, visitors may be charged money for visitors.

Lifeguard Services
